What a day for a walk.....

It's the day after Christmas and I just took my walk for the day. It made me both smile and sad at the things that I saw. The first thing that made me smile? I saw two boys out riding their brand new purple bicycles really proud of their new rides. They were trying to decide what to build a ramp out of so they could jump like I used to as I was a kid with my friend Jeff. (Quick side story here that I just remembered. When I was 13 or so we decided to jump our bikes in front of his house. My first jump of the day was the last because as I launched myself off the ramp, THE FRONT WHEEL OF MY BIKE FELL SMOOTH OFF!!!. I hadn't tightened it down well enough after I had replaced the inner tube in the tire. I wound up going face first into gravel and dirt. Hurt like a motherm that one!!!!) I turned the corner I saw a young family out in their front yard. As I got closer to them I noticed the young girl about 6 or 7 years old started running with her brown hair flying. Wait, she wasn't running she was kicking her new purple soccer ball towards a goal that was tended by her dad. Her mom ran along beside her trying to make it look as she was defending the goal also but, in reality, she was offering little resistance to the budding Mia Hamm. The girl deftly shot the ball past both of them into the goal and they all celebrated the goal. That's the perfect example of being a family to me. Then as I ventured further I saw a kid of about 12 out in his garage playing his new purple drum set. (Purple was the in color this year, I guess!!!) The sadder side of things that I saw were two seperate inflatable Santas that were no longer upright. One was laying on his back in the I've fallen and I can't get up position > We was still fully inflated just laying down. The second was completely deflated and laying on the ground looking very downtrodden. I mean if you are going to have Santa out in your front yard, you need to make sure he is taken care of!!! The other bummer of the day was I saw 2 or 3 people out pulling down their Christmas decorations off their houses. Now it will be back to where we really don't care about anyone other than our own little selves and the spirit of giving will be packed away for another year. It was a good walk because it excercised both my body and my mind!

TWIN FALLS, Idaho (AP) -- A man accused of using poison to kill his three young children told police he "didn't want the kids to suffer through the divorce," according to court papers.

Jim Junior Nice, 33, was charged Thursday with three counts of first-degree murder. He was ordered held without bail pending a preliminary hearing.

Nice admitted the killings after he was taken into custody, and "appeared despondent over his recent divorce," according to a police affidavit.

He also told police he had taken medications in an attempt to kill himself, the affidavit said.

An after-hours call Thursday to his attorney's office was not returned.

Fatally poisoned were 6-year-old twins, Justin and Spencer, and a 2-year-old girl, Raquel Anna.

Divorce records show Jim and Leslie Nice lost custody of the children after the 2004 drowning death of a fourth child, 22-month-old Ian Nice, in a ditch at a local park.

The children were placed in the custody of their grandparents for nine months.

After the couple divorced earlier this year, they shared custody of the children.

Police discovered the children's bodies Wednesday morning, after someone called the department to request that officers check on Jim Nice, who had failed to show up for work.

Nice answered the door when the officers knocked. When asked if he was OK, the man "hung his head, put his hand over his mouth, and shook his head no and replied, 'No I'm not,"' the affidavit said.

Nice opened the door wider, fell to the ground and began mumbling. Officers then spotted the three bodies lying on the living room floor.

I have driven in Dallas/Garland and I can understand

Richardson police may upgrade charges against a driver accused of road rage.

Kimberly Al-Homsi allegedly threatened a man with a hand grenade yesterday.

She then led police on a chase from North Dallas to Garland. It turns out that the grenade was not live, but she could be charged with making a terror threat.

Police say the hand grenade wasn't the only alarming object police said they found in Al-Homsi's car. They also confiscated additional ammunition that could have been used to create an explosive.

"As officers approached the car...they saw what appeared to be a couple of hand grenades inside the car," said Sgt. Kevin Perlich, Richardson Police Department.

Officers backed off when they discovered the explosive and called the Garland bomb squad, who pulled out three hand grenades.

Police checked the grenades and said they were real but did not have explosive material in them so they were not actively explosive, but they did find other ammunition inside the car.

"It is very serious," said Officer Joe Harn, Garland Police Department.

Police said the incident started as road rage between Kimberly Al Homsi, 41, and a male driver.

"She pulls out what appears to be a hand grenade, pulls the pin and starts making threatening motions like she is going to throw it at him," Harn said.

The male driver called Richardson police and they found Al-Homsi coming out of the parking lot of the Brighter Horizon's Academy in Garland where she had just picked up her teenage daughter. Police investigated to see if Al-Homsi made any threats while at the school.

"From what we could tell right now, there were no other threats made to anyone else other than the motorist which she had the altercation with," Perlich said. "So, no sign she was a harm or threat to anybody."

Police said they have not discovered why she had the items in her car.

Castle Rock - A popular former Ponderosa High School teacher who had sex with a troubled, underage student will spend two years in prison under a plea agreement announced today in Douglas County District Court.

Nicole Barnhart, 36, a married mother of two, will be sentenced Jan. 3 on two felony charges. In addition to prison time, the former Parker-area social studies teacher will receive at least 10 years of probation and must register as a sex offender.

The plea ended a nine-month saga involving the teacher and her former 16-year-old male student, a boy with whom Barnhart admitted having sex twice. The boy's parents have since notified the Douglas County School District of their intent to sue for $2 million.

Barnhart - her attorney stroking her back as comfort during the five-minute court proceeding - listened quietly as a prosecutor read details of the agreement to Judge Paul King. Barnhart did not speak and her attorney, Iris Eytan, declined comment afterward.

"I think the message here is that if you're a teacher having sex with kids and we can prove it, then you're going to prison," Deputy District Attorney Darren Vahle said in an interview.

As part of the deal, the Highlands Ranch woman will plead guilty to sexual assault on a child and criminal attempt to commit sexual assault on a child. The former teacher initially rejected a plea deal.

"It takes people a while to come to realize what's going to happen to them," Vahle said of the agreement.

David Savitz, the boy's attorney, did not return several calls seeking comment.

Barnhart was arrested in mid-March after a county sheriff's deputy spotted the teacher and the then-10th-grader together at the end of a dirt road in Castlewood Canyon. She resigned her teaching position later that month.

Barnhart allegedly had been counseling the sophomore for suicidal thoughts and for alcohol and cocaine abuse, according to court records.

The two struck up a relationship during their talks, with Barnhart cooking the boy lobster and other meals at her house while he hung out with her young children.

Barnhart later admitted to police that she kissed the boy, and "he begged me" for about 20 minutes for sex.

On March 10 they had sex in the back seat of her van, she told police. Five days later, she said, they again had sex in the van.

"He tells me he loves me and he wants to make love to me, and everything's OK," an arrest affidavit quotes her as saying.

In an interview with police, the boy said he was "safe" when he was with her. "I'm bigger than she is," he said in the interview.

Barnhart had been a teacher in the Douglas County School District since 1995 and at Ponderosa since August 2002. She had previously taught eighth-grade social studies at Highlands Ranch's Ranch View Middle School.

But Barnhart had a questionable past at Ponderosa, even before the sexual-assault charges.

At one time she was a cheerleading coach but was removed from the job, the school's principal told investigators, because "of issues with the cheerleaders' parents." She also once was reprimanded for having cheerleaders at her house playing "Truth or Dare," the principal said.

Students reported that she was immature at times.

Earlier this year, a website that uses student evaluations to rate teachers gave Barnhart high scores for not being tough. Out of a maximum score of 5, she received an average rating of 4.3.

Boy Accused of Rape Inside Church

Monday, a 14-year-old boy allegedly raped a 12-year-old girl during a Christmas play at a Warren Church. Police believe it is the first time in Macomb County that anyone has been accused of rape inside a church.

At St. Calvary Lutheran Church in Warren, during the annual Christmas play, a 14-year-old boy lured a 12-year-old girl into the boy’s bathroom. The boy allegedly fondled the girl and then raped her. The girl screamed and tried to get away but was unable to escape.

Church Pastor, Roger Facione, said, "We were, needless to say, just so upset. It’s so regrettable if it did happen as it has been alleged. Out prayers got out to both families. We don’t know what happened. I understand, from the police, that they were acquaintances. And I always think it’s so sad when you trust someone."

The 14-year-old boy has been charged with criminal sexual conduct in the first degree, which is an automatic waiver to adult court. If he is tried and convicted as an adult, he could go to prison for the rest of his life.

Boy Scout Gets Knife Lodged In Brain

KUTV) An incredible and un-suspecting accident leaves a Utah Boy Scout just inches from death when he was stabbed right between his eyes.

Jeff Jaeger spoke to Kevin Coulter and tells 2News how this was a truly freak accident.

While raking leaves for a Boy Scout event, one of the leaders flung a knife from his hand while trying to catch another scout who had tripped.

“It was dark, it was like 8:30 and there was a light and I saw it flash before it hit me,” said Kevin.

The blade landed in between his frontal lobes. It was 2 millimeters away from hitting a major blood vessel in his brain.

Kevin's doctors told him it was sheer luck where the knife hit.

“That's the sinuses that it went through and that I guess is where the brain lobe is right there,” said Kevin pointing to an X-Ray.

It was a freak accident in every way. Few people can admit they've seen anything like it, a 1 ½ inch blade through someone's skull.

“That's the best spot you know, if you're going to have a knife in your head,” said Kevin.

It amazingly wasn’t as painful as it looks; he says he just felt pressure.

In all, Kevin's kept a light heart about the whole situation. He got to miss out on a few weeks of school and yes, he walked away with the knife as a souvenir.

Richmond woman who has appeared in several pornographic movies is being sought for an illegal relationship with a 15-year-old boy from El Sobrante, for supplying the boy with illicit substances and for concealing him from his parents, said Detective Sgt. Mitch Peixoto Friday. Genevieve Elise Silva, 20, of Richmond, is accused of providing ecstasy and methamphetamine to a 15-year-old De Anza High School student during sexual encounters and convincing the boy to move to Oklahoma with her over the summer, Peixoto said. The boy is now receiving treatment for drug addiction. He began to tell his family and investigators what happened once treatment began, Peixoto said. Family members contacted police about the case because they were concerned that Silva might try to engage in similar illegal behavior with other young boys. Peixoto said the victim met Silva through her younger brother in June. Both boys attend De Anza High School in Richmond. The victim ran away from his home and moved in with Silva, her brother and her father. The boy's family immediately reported him as a runaway, Peixoto said. Investigators are not sure how long the victim lived in Richmond but know that he started a sexual relationship with Silva while living with her. He said that while living with her, she supplied him with amphetamines, ecstasy and marijuana. At some point -- Peixoto said investigators are not sure exactly when --Silva and her mother, Rhonda Silva, who is estranged from her husband, took the victim to Roosevelt, Okla., where the sexual relationship and drug use continued. Investigators are still not sure of Rhonda Silva's exact role in the case. The victim's parents found out where he was by talking to school friends and De Anza school authorities, Peixoto said. When police in Roosevelt picked up the victim he was reportedly under the influence of drugs. Peixoto said he believes the victim is in rehabilitation out of state. The boy had reportedly told his family the addresses of pornographic Web sites where Silva appeared. Peixoto said he found Silva's images on several pornographic Web sites. Police haven't been able to confirm or deny that Silva has been involved in pornography with young boys. The Web sites Silva appeared on do not appear to be involved in underage pornography, Peixoto said. The victim's parents has been told by their son's friends that Silva is in the Bay Area, Peixoto said. But police have visited her home several times and have spoken with her father, who has been "pretty forthcoming," and have not yet located her, he said.
